It most often happens in\n<strong>rear-end collisions<\/strong>, but can also arise from side\nimpacts, head-on collisions and other accidents.<\/p>\n<p>Although it is often dismissed in everyday speech as a \u201cminor\ninjury,\u201d the consequences vary widely. In some people the symptoms\ndisappear after a few weeks; in others they last for months or even\nyears. The most common symptoms include neck pain, stiffness of the\ncervical spine, headaches, pain radiating into the shoulders and arms,\ndizziness, tingling in the hands, reduced neck mobility, and difficulty\nwith everyday activities. These cases typically involve wearing a collar, a\nfew follow-up examinations, short physiotherapy, and transient pain and\nstiffness. In one recent judgment of the County Court in Split, for\nexample, a claimant was awarded <strong>\u20ac1,050<\/strong> for a cervical\nsprain without permanent consequences, even though the insurer had\ndisputed the causal link.<\/p>\n<h3 id=\"to-5-permanent-reduction\">3% to 5% permanent reduction<\/h3>\n<p>If lasting consequences remain after treatment, the figure rises\nsignificantly. For a permanent reduction of life activities of 3% to 5%,\nawards usually run between <strong>\u20ac2,500 and \u20ac4,000<\/strong>. These\ncases generally involve permanent restrictions of neck mobility, EMNG\nfindings confirming nerve-root damage, longer physiotherapy, and\nincreased effort in everyday activities. In one analysed case a young\nclaimant was awarded <strong>\u20ac3,524<\/strong> in non-material damages\nafter neurosurgical and orthopaedic assessments established a total of\n5% permanent reduction of life activities.<\/p>\n<h3 id=\"to-10-permanent-reduction\">5% to 10% permanent reduction<\/h3>\n<p>In more serious cases involving disc herniation, neurological\ndeficits or long-lasting pain, awards most often run between\n<strong>\u20ac4,000 and \u20ac7,000<\/strong>. These are injuries that can leave\nlong-term effects on quality of life and frequently require months or\nyears of treatment, typically including MRI, EMNG studies, multiple\nspecialist examinations and prolonged rehabilitation.<\/p>\n<h3 id=\"to-15-permanent-reduction\">10% to 15% permanent reduction<\/h3>\n<p>A permanent reduction of 10% to 15% almost always has a serious\nobjective medical basis \u2014 most commonly multi-level disc herniations,\nmore pronounced neurological consequences, chronic pain syndromes and\npermanent functional limitations. In almost every case where 15% or\nmore is established, there are <strong>additional serious\ninjuries<\/strong> \u2014 neurological damage, shoulder-girdle injuries,\ntraumatic brain injury, post-traumatic stress disorder (PTSD) or other\nlasting psychological consequences. Non-material damages then often\nexceed <strong>\u20ac10,000<\/strong>, and the total value of the case can be\nmuch higher once lost earnings, treatment costs and other material\ndamage are added.<\/p>\n<h2 id=\"what-affects-the-amount\">What affects the amount?<\/h2>\n<p>Two people can share the same diagnosis and recover very different\nsums, because courts award compensation not for the label of the\ndiagnosis but for the <strong>actual consequences<\/strong> the injury\nleaves on the person\u2019s life. In deciding, courts rely above all on the\nfindings of medical experts \u2014 which is why the medical expert assessment\nis the single most important piece of evidence in almost every whiplash\ncase.<\/p>\n<p><strong>Physical pain.<\/strong> Experts grade pain as strong, medium\nor mild and estimate how many days each lasted; the court then weighs\nthe overall intensity and duration. Someone who felt strong pain for a\nday or two and fully recovered within weeks will recover far less than\nsomeone in pain for months who needs prolonged rehabilitation.<\/p>\n<p><strong>Fear.<\/strong> Fear is a separate head of non-material\ndamage. Courts distinguish primary fear (the moment of the accident\nitself), secondary fear (worry about one\u2019s health and the outcome of\ntreatment), and late or prolonged fear. Where a psychiatric expert finds\nan acute stress reaction, an anxiety-depressive disorder or similar\nconsequences, awards are regularly higher.<\/p>\n<p><strong>Reduction of life activities.<\/strong> This is often the\ndecisive factor \u2014 the percentage by which the injury permanently changes\neveryday life. For whiplash the estimates are most often between 2% and\n10%, though they can be higher with serious neurological consequences or\na combination of injuries. It can include limited neck mobility, chronic\npain, reduced physical endurance, difficulty at work, and difficulty\nwith sport and recreation.<\/p>\n<p><strong>Duration of treatment.<\/strong> Longer treatment usually\nmeans longer-lasting pain, fear and daily limitations, which directly\nraises the award. Cases involving MRI, EMNG and months of rehabilitation\nregularly attract higher sums than those resolved within a few\nweeks.<\/p>\n<p><strong>Age.<\/strong> There is no automatic rule that younger people\nreceive more, but courts take into account that permanent consequences\nmay affect a younger person\u2019s life for much longer \u2014 a permanent\nlimitation in a 25-year-old can have a far greater lifetime impact than\nthe same limitation near the end of a working life.<\/p>\n<p><strong>Psychological consequences.<\/strong> One of the most\nunderestimated elements. Where an accident leads to an acute stress\nreaction, anxiety, depression or PTSD, the total award can be\nsubstantially higher than it would be on the physical neck injury\nalone.<\/p>\n<h2 id=\"what-most-increases-the-amount\">What most increases the\namount?<\/h2>\n<p>As a rule of thumb: the more <strong>objective evidence<\/strong>\nthere is of the seriousness of the injury and its permanent\nconsequences, the more likely a court is to award a higher sum.<\/p>\n<p><strong>EMNG findings.<\/strong> Electromyoneurography assesses the\nfunction of the peripheral nerves and muscles and can demonstrate\nnerve-root damage that standard imaging does not show. A positive EMNG\noften marks the dividing line between a minor and a serious injury. In\none analysed judgment a neurosurgical expert found moderate damage to\nthe C7 and C8 cervical nerve roots confirmed by EMNG \u2014 a key reason the\ncourt accepted permanent consequences and awarded considerably more than\nit would for a simple muscle strain.<\/p>\n<p><strong>MRI and disc herniation.<\/strong> MRI is often the most\nimportant objective evidence in serious cervical injuries, showing disc\nprotrusions or herniations, nerve-root compression, and post-traumatic\nchanges. In one analysed case an MRI confirmed a traumatic disc\nherniation that resulted in a 10% permanent reduction of life\nactivities, and the court awarded more than <strong>\u20ac5,700<\/strong> in\nnon-material damages. Not every herniation is caused by the accident,\nthough \u2014 insurers frequently argue it reflects earlier degeneration, so\nthe expert\u2019s view on causation is decisive.<\/p>\n<p><strong>Permanent consequences.<\/strong> Almost always the single\nbiggest factor, because \u2014 unlike pain and fear, which relate to a period\nof time \u2014 permanent consequences remain after treatment ends. The\ndifference between a 2% and a 10% reduction can mean several thousand\neuro.<\/p>\n<p><strong>Long treatment<\/strong>, <strong>psychiatric\nassessment<\/strong> (PTSD and similar), and <strong>multiple expert\nassessments<\/strong> (orthopaedic, neurological, neurosurgical,\npsychiatric, traffic) all tend to push awards up \u2014 the highest sums\nalmost always involve objectively confirmed neurological, orthopaedic or\npsychological damage rather than a simple muscle strain. One technical\npoint worth knowing: under newer case law, percentages of permanent\nreduction are summed only where they relate to <strong>different organic\nsystems<\/strong>; a psychiatrist\u2019s percentage is not automatically added\nto an orthopaedist\u2019s. Even when they are not formally added, however,\npsychological consequences often raise the overall fair\ncompensation.<\/p>\n<h2 id=\"what-can-reduce-or-defeat-the-claim\">What can reduce or defeat\nthe claim?<\/h2>\n<p>It is not enough simply to prove that an accident happened \u2014 you must\nalso prove that the specific health problems are a consequence\n<strong>of that accident<\/strong>, and that there are no circumstances\nreducing or excluding the insurer\u2019s liability. In practice, questions of\ncausation, prior health and the injured party\u2019s own contribution are the\nmost common reasons claims are reduced or partly rejected.<\/p>\n<p><strong>Causation \u2014 the most disputed issue.<\/strong> It is not\nenough to show you now have neck pain; you must show the pain stems from\nthis accident. Insurers build most of their defence here. The outcome depends on the collision, the\nquality of the expert evidence, the claimant\u2019s health, and the approach\nof the particular court.<\/p>\n<p><strong>Lack of medical documentation.<\/strong> Delaying the first\nmedical examination is one of the biggest mistakes. If the first visit\nis days or weeks after the accident, the insurer will often argue the\nsymptoms are unrelated. The initial documentation is frequently the most\nimportant evidence, so neck pain, limited mobility, headaches, dizziness\nand tingling should be recorded immediately. Problems arise when serious\nfindings (EMNG, MRI) appear years later with no mention of the neck in\nthe early records.<\/p>\n<p><strong>Prior degenerative changes.<\/strong> Insurers often argue the\ncomplaints reflect natural degeneration (spondylosis, disc protrusions,\nearlier herniations), especially in middle-aged and older claimants.\nTheir mere existence does not defeat a claim. The key question is\nwhether the accident <strong>caused a new injury or significantly\nworsened<\/strong> a pre-existing condition; if the expert confirms that\ncausal link, courts generally accept the claim.<\/p>\n<p><strong>Not wearing a seatbelt.<\/strong> Courts distinguish injuries\na belt would have prevented from those that can occur regardless.\nWhiplash can occur even when properly belted, but not wearing a belt can\nstill feed into an assessment of the injured party\u2019s contribution and\nreduce the award.<\/p>\n<h2 id=\"contribution-of-the-injured-party\">Contribution of the injured\nparty<\/h2>\n<p>Under the general rules of tort law, a person who partly contributed\nto the damage cannot claim full compensation. The court establishes the\npercentage of contribution and reduces the award by the same percentage\n\u2014 a 10% contribution means a 10% reduction, 20% means 20%, and so on.\nTypical grounds include not wearing a seatbelt, speeding, or other\ntraffic offences that contributed to the event.
