For\ncross-border accidents inside the EU this is confirmed by the\n<strong>Rome II Regulation<\/strong>, and the <strong>1971 Hague\nConvention on the Law Applicable to Traffic Accidents<\/strong> likewise\npoints to the law of the place of the accident.<\/p>\n<p>In practice this means the <strong>types and amount of your\ncompensation are decided under Croatian rules<\/strong>, even if part of\nthe process later runs through your home country. The separate question\nof <em>where<\/em> you can bring the claim \u2014 in Croatia or at home \u2014 is\ndealt with further below. The two Croatian statutes that matter most are\nthe <strong>Civil Obligations Act (<em>Zakon o obveznim odnosima<\/em>,\nZOO)<\/strong> and the <strong>Compulsory Traffic Insurance Act\n(<em>Zakon o obveznim osiguranjima u prometu<\/em>, ZOOP)<\/strong>.<\/p>\n<h2 id=\"who-is-entitled-to-compensation\">Who is entitled to\ncompensation?<\/h2>\n<p>Your right to compensation does not depend simply on who was involved\nin the accident, but on <strong>who is responsible for the\ndamage<\/strong> and on the <strong>legal basis<\/strong> of the claim.\nUnder Croatian law the picture breaks down as follows.<\/p>\n<h3 id=\"people-who-were-not-responsible-for-the-accident\">People who\nwere not responsible for the accident<\/h3>\n<p>People who did not cause the accident are entitled to <strong>full\ncompensation<\/strong>. That includes a driver who was not at fault,\n<strong>passengers<\/strong> in any of the vehicles (regardless of who\ncaused the crash), and <strong>pedestrians or cyclists<\/strong> who did\nnot contribute to the damage. If you fall into this group, the fact that\nyou were a visitor changes nothing about your entitlement.<\/p>\n<h3 id=\"people-who-were-partly-responsible\">People who were partly\nresponsible<\/h3>\n<p>A person who is <strong>partly responsible<\/strong> for the accident\ncan still claim, but the compensation is then reduced in proportion to\ntheir contribution to the damage. Two points are crucial here. First,\nthat contribution <strong>must be proven<\/strong> \u2014 there is no\nautomatic reduction. Only a court can establish the causal contribution,\nand it does so on the basis of expert findings, the police report, the\nstatements of the parties and witnesses, video footage and similar\nevidence. Second, in practice insurers routinely read \u201ccontribution\u201d far\ntoo broadly, using it as a lever to refuse payment or to cut it sharply\nduring negotiations.<\/p>\n<p>There is also an important nuance specific to road traffic. Because a\nmotor vehicle is treated as a <strong>\u201cdangerous thing\u201d (Art. 1063\nZOO)<\/strong>, the vehicle\u2019s owner is <strong>objectively\nliable<\/strong> \u2014 liable without fault. The consequence is striking:\n<strong>even a driver who was not at fault<\/strong> can be required to\ncompensate a pedestrian or cyclist who themselves caused the accident.\nThe court can then weigh the injured person\u2019s own contribution, in\nextreme cases up to 100%. Compensation is not automatically wiped out,\nbut it can be reduced to very little \u2014 for example, in case\n<em>G\u017e-3029\/2016-3<\/em> a pedestrian\u2019s contribution was assessed at\n<strong>80%<\/strong>.<\/p>\n<h3 id=\"family-members-and-heirs-of-those-killed\">Family members and\nheirs of those killed<\/h3>\n<p>Where an accident results in <strong>death or particularly severe\ndisability<\/strong>, the right to compensation belongs to the victim\u2019s\nclose family: a <strong>spouse or partner, children and\nparents<\/strong>, and other close persons who lived in a lasting\ncommunity of life with the victim \u2014 a relationship that must be capable\nof proof before the court.<\/p>\n<h2 id=\"who-do-you-claim-compensation-from\">Who do you claim\ncompensation from?<\/h2>\n<p>Most commonly, compensation is claimed from the <strong>insurer of\nthe vehicle that caused the accident<\/strong>, under compulsory motor\nthird-party liability insurance. For a foreigner this runs through the\n<strong>Green Card system<\/strong>: if the at-fault car is insured\nabroad, that foreign insurer has an <strong>authorized claims\nrepresentative in Croatia<\/strong> who handles the claim locally, and\n<strong>EU\/EEA residents<\/strong> can often pursue the claim through the\ninsurer\u2019s representative in their own country, or through a national\ncompensation body.<\/p>\n<p>If the driver who caused the accident <strong>fled the scene<\/strong>\nand the vehicle cannot be identified, or the vehicle <strong>was not\ninsured<\/strong> (including a foreign vehicle without a valid Green\nCard), the claim is made to the <strong>Croatian Insurance Bureau\n(<em>Hrvatski ured za osiguranje<\/em>, HUO)<\/strong> and its Guarantee\nFund.<\/p>\n<p>Liability, however, is not always the driver\u2019s or their insurer\u2019s\nalone. Depending on how the accident happened, the responsible party may\ninstead \u2014 or in addition \u2014 be:<\/p>\n<ul>\n<li>an <strong>employer<\/strong>, where the accident is connected with\nwork;<\/li>\n<li>a <strong>transport operator<\/strong>, for example a bus\ncompany;<\/li>\n<li>the entity responsible for <strong>road maintenance<\/strong> (the\nmotorway operator HAC, municipal road companies and the like), where the\ncause was poor maintenance or an unmarked obstacle;<\/li>\n<li>the <strong>hunting concessionaire or the Croatian Hunting\nFederation<\/strong>, for damage caused by game crossing the road;<\/li>\n<li><strong>another person<\/strong> who contributed to the damage, in\nsituations such as a falling tree or a container blown onto the road by\nthe wind.<\/li>\n<\/ul>\n<p>Identifying the correct legal basis matters more than it might seem:\na claim aimed at the wrong party wastes time and can let the claim\n<strong>prescribe<\/strong> (become time-barred) before it is\ncorrected.<\/p>\n<h2 id=\"proving-your-claim\">Proving your claim<\/h2>\n<p>To establish the elements of a claim \u2014 the damage, the responsible\nparty, the harmful act, and the causal link between them \u2014 it is\nessential to gather as much evidence as possible at the moment the\naccident happens.<\/p>\n<p>The <strong>European Accident Statement (<em>Europsko izvje\u0161\u0107e o\nnesre\u0107i<\/em>)<\/strong> is the single most important document, recognised\nunder <strong>Art. 38 ZOOP<\/strong>; it records both drivers\u2019 accounts\nand the insurers\u2019 details, and it is what the claim is built on.\nAlongside it, collect as many <strong>photographs and videos<\/strong> as\nyou can, showing how the accident occurred.<\/p>\n<p>The <strong>police report<\/strong> is the next pillar. Nobody enjoys\nwaiting for the police, and it can feel unnecessary, but the report\nmakes recovery from the other side far easier and shortens the whole\nprocess. Be aware, though, that police reports often use loaded phrases\nsuch as \u201cshared responsibility\u201d or \u201cthe injured party\u2019s contribution\u201d \u2014\nand insurers will seize on exactly that wording to reduce what they owe.\nFor that reason it is important to <strong>take an active part in how\nthe report is written<\/strong>, and to insist that photographs and the\nfull sequence of events are entered into it.<\/p>\n<p>Finally, keep your <strong>medical records, bills, evidence of\nthird-party care and help, photographs and witness details<\/strong> \u2014\nanything that shows your injuries and the damage to your vehicle and\nbelongings are a consequence of this accident. If you were genuinely\ninjured, see a doctor <strong>immediately<\/strong>, even for symptoms\nthat seem minor: whiplash in particular often appears only hours or days\nlater, and a gap in the records is something insurers exploit. As a\nforeigner, <strong>keep all of this even after you return home<\/strong>\n\u2014 the claim can be run from abroad.<\/p>\n<h2 id=\"how-the-amount-is-determined\">How the amount is determined<\/h2>\n<p>The amount of <strong>non-material (pain-and-suffering)\ndamages<\/strong> is set according to the <strong>Supreme Court\u2019s\nOrientation Criteria (<em>Orijentacijski kriteriji VSRH<\/em>)<\/strong> \u2014\nthat is, the type and severity of the injuries, the duration of\ntreatment, and the consequences for the injured person\u2019s everyday life.\nFor lighter injuries, such as whiplash, a formal medical expert\nassessment is often unnecessary, because the amounts are already settled\nin practice. For more serious injuries, long treatment or permanent\nconsequences, it is advisable to obtain a <strong>preliminary medical\nexpert assessment<\/strong> so that the claim is set correctly from the\nvery start. In every case, <strong>chronologically organised\ndocumentation<\/strong> is what makes it possible to put a figure on the\nclaim and support it.<\/p>\n<p>On top of non-material damages, you can recover your <strong>material\nlosses<\/strong> \u2014 medical and rehabilitation costs, lost earnings, a\nfuture <strong>annuity (<em>renta<\/em>)<\/strong> where the injury\npermanently reduces your earning capacity, and the <strong>damage to\nyour vehicle<\/strong> and belongings. Vehicle damage is assessed by the\ninsurer; you can also obtain a mechanic\u2019s estimate for an idea of the\norder of magnitude, and in litigation a court expert will determine it.\nIf you repaired the vehicle yourself, <strong>keep all the\ninvoices<\/strong>. Awards are made in\n<strong>euro<\/strong>, so any losses incurred in another currency are\nconverted, typically at the exchange rate on the relevant date;\n<strong>proving foreign income and costs<\/strong> depends on well-kept\npayslips, employer confirmation, tax records and invoices; and\n<strong>necessary treatment received back home<\/strong> is recoverable,\nprovided it is justified and documented.<\/p>\n<h2 id=\"the-claim-process-step-by-step\">The claim process, step by\nstep<\/h2>\n<p>Once you have collected the relevant documentation about the accident\nand the damage, the recovery process can begin. You can run it yourself,\nbut experience shows that instructing a lawyer who works in compensation\ncases is the safest route to full and fair payment.<\/p>\n<p><strong>Step 1 \u2014 the written claim.<\/strong> The process starts by\nsubmitting a <strong>written claim<\/strong> to the insurer of the\nat-fault vehicle (or to the responsible party). The claim normally sets\nout a description of the accident, the legal basis of liability, a list\nof the attached medical and traffic documentation, the specific amount\nsought, and the date from which default interest is claimed. The more\ncomplete the documentation and the more precisely the claim is drafted,\nthe greater the chance the insurer accepts it without the need for\ncourt.<\/p>\n<p><strong>Step 2 \u2014 the insurer\u2019s handling and negotiations.<\/strong>\nAfter receiving the claim, the insurer carries out its own assessment\nand may request further medical documentation, send you for an\nadditional medical examination, order a vehicle or medical expert\nassessment, or dispute liability or the causal link between the accident\nand your injuries. This is the stage at which insurers most often try to\npush the amount down, especially with lighter injuries and subjective\ncomplaints such as pain and fear. It is precisely why having a lawyer\nwho negotiates in your interest \u2014 rather than accepting the first sum\noffered \u2014 matters so much. If the parties agree, the matter can be\nconcluded relatively quickly, sometimes within a few months.<\/p>\n<p><strong>Step 3 \u2014 the undisputed part, and\/or court\nproceedings.<\/strong> If the insurer accepts the claim in full, payment\nfollows. If it offers a sum well below what is justified, you can accept\nthe so-called <strong>\u201cundisputed part\u201d<\/strong> and give up the rest,\nor you can bring <strong>court proceedings<\/strong> for the remainder.\nIn court, the judge will examine all the circumstances of the accident\n(often appointing a traffic expert), assess the responsibility and any\ncontribution of the injured party and third persons, and decide whether\nthe amount claimed is justified. Litigation usually takes longer and\ncosts more, but it is frequently necessary when an insurer unjustifiably\nreduces or refuses payment.<\/p>\n<h2 id=\"how-long-does-the-insurer-have-to-respond-to-your-claim\">How\nlong does the insurer have to respond to your claim?<\/h2>\n<p>Croatian law sets a firm deadline for the insurer to respond to your\nclaim \u2014 and how long that deadline is depends on <strong>where the\nat-fault vehicle is registered<\/strong>. This matters in practice,\nbecause the same deadline marks the point from which you are allowed to\ngo to court.<\/p>\n<p><strong>If the at-fault vehicle is registered in Croatia \u2014 60 days\n(Art. 12 ZOOP).<\/strong> The Croatian insurer must, within <strong>60\ndays<\/strong> of receiving your claim, deliver either a <strong>reasoned\noffer<\/strong> of compensation (where it does not dispute liability and\nhas established the amount) or a <strong>reasoned reply to every\npoint<\/strong> of the claim (where liability or the amount is disputed).\nIf it does neither in time, you may sue \u2014 and a lawsuit filed\n<em>before<\/em> the 60 days run out is treated as\n<strong>premature<\/strong>. The insurer must also pay any\n<strong>undisputed amount as an advance<\/strong> within 15 days of\nsending its offer, and in any event within 60 days of receiving the\nclaim (Art. 12(5) ZOOP).<\/p>\n<p><strong>If the at-fault vehicle is registered in another EU\/EEA state\n\u2014 3 months (Art. 50 ZOOP).<\/strong> When the vehicle that caused the\naccident is registered in another EU\/EEA country, its insurer has a\ndesignated <strong>authorized claims representative<\/strong> in Croatia\n\u2014 a local person or company that, on the foreign insurer\u2019s behalf,\ngathers information and settles claims in Croatia (Art. 47 ZOOP). The\nrepresentative (or the responsible insurer itself) must deliver a\nreasoned offer or a reasoned reply <strong>within 3 months<\/strong> of\nthe claim being submitted. If they miss that deadline, you are entitled\nto <strong>sue in the place of your own residence<\/strong> \u2014 which, for\na foreign claimant who has returned home, in principle means <strong>in\nyour home country<\/strong> (Art. 50 ZOOP). A representative who breaks\nthis deadline can also be <strong>fined<\/strong> (Art. 63(7) ZOOP).<\/p>\n<p>One related mechanism is worth clarifying so you don\u2019t go looking for\nit by mistake. The <strong>Compensation Body<\/strong> at the Croatian\nInsurance Bureau (HUO) is a fallback channel that exists <strong>only\nfor people resident in Croatia who were injured abroad<\/strong>, and\nonly where the foreign insurer or its representative missed the\nthree-month deadline (Art. 57\u201358 ZOOP, with a two-month response time).\nIt is <strong>not<\/strong> available to a foreigner injured in Croatia \u2014\nin that case the route is the authorized representative under Art.\n50.<\/p>\n<h2 id=\"the-most-common-reasons-insurers-reduce-payouts\">The most common\nreasons insurers reduce payouts<\/h2>\n<p>In compensation claims after a traffic accident, insurers very often\ndo not dispute the right to compensation as such \u2014 instead they try to\n<strong>reduce the amount paid<\/strong>, relying on various\ncircumstances that, on their reading, limit the extent of their\nliability. These arguments are not always well founded in law, but they\nrecur reliably, especially during negotiations. The ones you are most\nlikely to meet are:<\/p>\n<ul>\n<li>an <strong>alleged contribution by the injured party<\/strong> \u2014 for\nexample over speed, reaction in traffic, or the manner of taking part in\nthe accident (most often drawn from the police report);<\/li>\n<li><strong>disputing the causal link<\/strong> between the accident and\nthe injuries, particularly with lighter injuries, pain and fear;<\/li>\n<li>a <strong>delay in seeing a doctor<\/strong>, used to argue that the\nhealth complaints cannot be reliably tied to the accident;<\/li>\n<li><strong>incomplete or insufficient medical documentation<\/strong>,\nused to shrink the recognised extent of the damage;<\/li>\n<li><strong>differences in assessing the severity of the\ninjuries<\/strong>, where the insurer downplays the intensity and\nduration of the pain compared with the real situation;<\/li>\n<li><strong>offers below the Orientation Criteria<\/strong>, made in the\nexpectation that the injured person will accept a quick payment without\nchallenging it.<\/li>\n<\/ul>\n<p>None of this should be accepted automatically. Each reason needs to\nbe analysed against the actual documentation and the circumstances of\nthe accident. In a great many cases a properly framed claim and\nwell-conducted negotiations lead to a <strong>significantly better\noutcome<\/strong> for the injured party, without the need for lengthy\nlitigation.<\/p>\n<h2 id=\"time-limits-and-prescription\">Time limits and prescription<\/h2>\n<p>Under <strong>Art. 230 ZOO<\/strong>, a compensation claim generally\nbecomes time-barred in <strong>three years<\/strong> from when the\ninjured party learned of the damage and of the responsible party (the\nsubjective deadline), and in any event in <strong>five years<\/strong>\nfrom when the damage occurred (the objective deadline). For\n<strong>material damage<\/strong>, such as damage to the vehicle, time\nruns from the <strong>date of the accident<\/strong>; for\n<strong>non-material damage<\/strong> \u2014 physical injury, fear and pain \u2014\nit runs from the <strong>end of treatment<\/strong>.<\/p>\n<p>This is the general rule, and there are nuances, particularly around\nwhat counts as the end of treatment or the date of knowledge. There is\nalso still divergent court practice on exactly when a non-material claim\nprescribes. In serious accidents it is not unusual for treatment to\ncontinue for years, with permanent consequences established only later \u2014\nwhich is why it is often wiser to <strong>file the claim before the\nthree years run out<\/strong>, rather than risk prescription.<\/p>\n<p><strong>When the accident is also a criminal offence<\/strong>, a\nlonger deadline can apply (Art. 231 ZOO), but this is narrower than it\nfirst appears. The Supreme Court harmonised the practice in 2023\n(<em>Rev-322\/2023-2<\/em>, 25 April 2023): the longer period applies\n<strong>only where the criminal proceedings end in a final\nconviction<\/strong>, and the limitation then runs <strong>from the date\nthat conviction becomes final \u2014 not from the date of the\naccident<\/strong> \u2014 whether or not you joined a civil claim to the\ncriminal case. If the proceedings end <strong>without a\nconviction<\/strong> (discontinuance or acquittal), the ordinary\nthree-\/five-year rules apply instead. The same position has been\nconfirmed in later decisions (<em>Rev-195\/2022-2<\/em>,\n<em>Revd-4283\/2023-2<\/em>, and <em>G\u017e-3553\/2025-2<\/em>).<\/p>\n<p>Two practical mechanisms stop the clock. <strong>Filing your written\nclaim with the insurer<\/strong> in the mandatory pre-litigation\nprocedure interrupts prescription in the same way a lawsuit does (see\ne.g. <em>G\u017e-2382\/2022-2<\/em>): time stops while the insurer deals with\nthe claim, and a fresh period then begins. And once you <strong>file a\nlawsuit<\/strong>, prescription is interrupted for the claims set out in\nit, so you no longer need to worry about losing those. One caveat that\ncatches people out: if wider consequences emerge later and you\n<strong>expand the claim<\/strong>, prescription for the expanded part is\ninterrupted only when you file that expansion \u2014 not by the original\nlawsuit.<\/p>\n<h2 id=\"should-i-claim-in-croatia-or-in-my-home-country\">Should I claim\nin Croatia or in my home country?<\/h2>\n<p>This is the strategic question many foreign claimants get wrong. For\n<strong>EU\/EEA residents<\/strong>, the damages are still assessed under\n<strong>Croatian law<\/strong> (Rome II), but EU rules can give you a\nchoice of forum, and a judgment is straightforward to enforce across the\nEU under the <strong>Brussels I bis<\/strong> framework. Many foreign\nfirms advertise \u201cclaim from home\u201d; that can feel convenient, but a claim\nhandled <strong>in Croatia, in Croatian, against the Croatian insurer or\nits local representative<\/strong> is often faster and avoids translation\nand procedural friction. For <strong>non-EU residents<\/strong>, the\nclaim is generally pursued in Croatia, with procedure and enforcement\ngoverned by Croatian law and any applicable conventions.
