Poznavanje ispravnih koraka nakon takvog doga\u0111aja klju\u010dno je za osiguranje prava radnika i ispunjenje obveza poslodavca.\u200b<\/p>\n\n\n\n<p>U <a href=\"https:\/\/marcetic.hr\/index.php\/2025\/05\/02\/ozljeda-na-radu-kada-radnik-ima-pravo-na-odstetu\/\" target=\"_blank\" rel=\"noopener\" title=\"Ozljeda na radu: Kada radnik ima pravo na OD\u0160TETU?\">pro\u0161lom \u010dlanku<\/a> mogli ste nau\u010diti kada Radnik ima pravo na naknadu \u0161tete nakon ozljede na radu, dok \u0107ete u ovom nau\u010diti koji su prakti\u010dni koraci koje morate poduzeti u slu\u010daju ozljede.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Koraci koje radnik treba poduzeti:<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Prijava ozljede:<\/strong> Radnik je du\u017ean odmah prijaviti ozljedu poslodavcu i, ako je potrebno, zatra\u017eiti medicinsku pomo\u0107.\u200b<\/li>\n\n\n\n<li><strong>Prijava HZZO<\/strong> &#8211; Radnik je du\u017ean <strong><span style=\"text-decoration: underline;\">u roku od 8 dana prijaviti ozljedu<\/span><\/strong> nadle\u017enom regionalnom uredu Hrvatskog zavoda za zdravstveno osiguranje. To za njega mo\u017ee u\u010diniti izabrani doktor op\u0107e prakse na njegov zahtjev.<\/li>\n\n\n\n<li><strong>Medicinska dokumentacija:<\/strong> Va\u017eno je dobiti lije\u010dni\u010dku potvrdu o prirodi i opsegu ozljede, koja \u0107e slu\u017eiti kao dokaz u daljnjim postupcima.\u200b<\/li>\n\n\n\n<li><strong>Evidentiranje okolnosti:<\/strong> Preporu\u010duje se zabilje\u017eiti sve relevantne informacije o doga\u0111aju, uklju\u010duju\u0107i svjedoke, kako bi se olak\u0161ao postupak dokazivanja.\u200b<\/li>\n<\/ol>\n\n\n\n<p>Dakle, vidimo da je vrlo bitno da Radnik odmah po nastanku ozljede po\u010dne aktivno djelovati kako bi \u0161to vi\u0161e olak\u0161ao daljnji proces dokazivanja i ostvarivanja prava.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prava radnika nakon ozljede:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Naknada pla\u0107e:<\/strong> Tijekom bolovanja zbog ozljede na radu, radnik ima pravo na naknadu pla\u0107e u iznosu od 100% prosje\u010dne neto pla\u0107e ispla\u0107ene u posljednjih \u0161est mjeseci prije ozljede.\u200b<br>Naknadu pla\u0107e za prva 42 dana privremene nesposobnosti ispla\u0107uje poslodavac, dok od 43. dana na dalje obvezu preuzima Republika Hrvatska. <\/li>\n\n\n\n<li><strong>Pokrivanje tro\u0161kova lije\u010denja:<\/strong> HZZO snosi tro\u0161kove medicinske skrbi povezane s ozljedom na radu.\u200b<\/li>\n\n\n\n<li><strong>Naknada \u0161tete:<\/strong> Ako je ozljeda nastala zbog propusta poslodavca, radnik mo\u017ee tra\u017eiti dodatnu naknadu za pretrpljenu bol, smanjenje radne sposobnosti ili druge posljedice.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/04\/ozljeda-na-radu-koraci--1024x768.png\" alt=\"ozljeda na radu od\u0161teta \" class=\"wp-image-2406\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/04\/ozljeda-na-radu-koraci--1024x768.png 1024w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/04\/ozljeda-na-radu-koraci--300x225.png 300w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/04\/ozljeda-na-radu-koraci--768x576.png 768w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/04\/ozljeda-na-radu-koraci-.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Podno\u0161enje od\u0161tetnog zahtjeva<\/h2>\n\n\n<div class=\"gb-container gb-container-311a3b2a\">\n\n<p>Postupak ostvarivanja naknade \u0161tete zapo\u010dinje podno\u0161enjem od\u0161tetnog zahtjeva, koji se naj\u010de\u0161\u0107e upu\u0107uje osiguravatelju poslodavca, budu\u0107i da su svi poslodavci du\u017eni imati odgovaraju\u0107e osiguranje. <\/p>\n\n<\/div>\n\n\n<p>U ve\u0107ini slu\u010dajeva, upravo osiguratelj rje\u0161ava zahtjev, no ako osiguranje odbije zahtjev kao neosnovan \u2013 primjerice, u situacijama gdje postoji izravna odgovornost poslodavca zbog nepo\u0161tivanja propisa o za\u0161titi na radu \u2013 tada se zahtjev mo\u017ee usmjeriti izravno prema samom poslodavcu.<\/p>\n\n\n\n<p>Vrlo su \u010desti slu\u010dajevi kada osiguravatelj od\u0161tetni zahtjev ne usvoji u cijelosti, ve\u0107 djelomi\u010dno. <br>U tom slu\u010daju nesporni iznos bit \u0107e ispla\u0107en na ra\u010dun Radnika. U odnosu na sporni dio koji osiguravatelj nije priznao, Radnik \u0107e imati pravo zatra\u017eiti sudskim putem u parnici.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Koju \u0161tetu radnik mo\u017ee potra\u017eivati? <\/h2>\n\n\n\n<p>Radnik nije ograni\u010den u svojem od\u0161tetnom zahtjevu te on mo\u017ee potra\u017eivati imovinsku i neimovinsku \u0161tetu. <\/p>\n\n\n\n<p>Imovinska \u0161teta naj\u010de\u0161\u0107e \u0107e uklju\u010divati naknadu za uni\u0161tene osobne stvari poput odje\u0107e, vozila, mobitela i sli\u010dno, ovisno o \u0161teti koja je nastala. <\/p>\n\n\n\n<p>S druge stranke, neimovinska \u0161teta jo\u0161 se naziva i nematerijalnom \u0161tetom ili povredom prava osobnosti prema va\u017ee\u0107em <a href=\"https:\/\/www.zakon.hr\/z\/75\/zakon-o-obveznim-odnosima\" title=\"\">Zakonu o obveznim odnosima<\/a>, a u \u010dl. 19 st. 2. prava osobnosti definira su kao: <br><br><em>&#8220;Pod pravima osobnosti u smislu ovoga Zakona razumijevaju se <strong><span style=\"text-decoration: underline;\">prava na \u017eivot, tjelesno i du\u0161evno zdravlje, ugled, \u010dast, dostojanstvo, ime, privatnost osobnog i obiteljskog \u017eivota, slobodu i dr.<\/span><\/strong>&#8220;<\/em><br><br>Ovaj oblik \u0161tete naj\u010de\u0161\u0107e se odnosi na \u0161tetu zbog pretrpljenih fizi\u010dkih bolova, \u0161tetu zbog pretrpljenog straha, \u0161tetu zbog pretrpljenih du\u0161evnih bolova zbog smanjenog \u017eivotnog aktiviteta, \u0161tetu na ime naknade za tu\u0111u pomo\u0107 i njegu, \u0161teta zbog nastalog naru\u017eenja itd.<\/p>\n\n\n\n<p>Dakle, pravo na naknadu prava osobnosti odnosno neimovinske \u0161tete razlikuje se od prava naknade materijalne odnosno imovinske \u0161tete. <\/p>\n\n\n\n<p>Jedino pravo ne isklju\u010duje drugo te vrlo \u010desto imamo slu\u010daj kada od\u0161tetni zahtjev sadr\u017ei oba prava.<br><br>Ako \u017eelite saznati kako izra\u010dunati okviran iznos neimovinske \u0161tete isto mo\u017eete prona\u0107i u <a href=\"https:\/\/marcetic.hr\/index.php\/2024\/12\/14\/kako-izracunati-iznos-naknade-neimovinske-stete\/\" title=\"Kako izra\u010dunati iznos naknade neimovinske \u0161tete?\">na\u0161em \u010dlanku<\/a>.<\/p>\n\n\n\n<p>U praksi se \u010desto doga\u0111a da radnici nisu dovoljno informirani o svojim pravima kada do\u0111e do ozljede na radu ili u vezi s radom, niti znaju kako zapo\u010deti postupak za ostvarivanje naknade \u0161tete. Zato je izuzetno va\u017eno, odmah nakon takvog doga\u0111aja, potra\u017eiti savjet stru\u010dnjaka.
