{"id":2350,"date":"2025-03-13T22:24:35","date_gmt":"2025-03-13T21:24:35","guid":{"rendered":"https:\/\/marcetic.hr\/?p=2350"},"modified":"2025-12-30T18:06:44","modified_gmt":"2025-12-30T17:06:44","slug":"etaziranje-bez-pristanka-suvlasnika","status":"publish","type":"post","link":"https:\/\/marcetic.hr\/index.php\/2025\/03\/13\/etaziranje-bez-pristanka-suvlasnika\/","title":{"rendered":"ETA\u017dIRANJE BEZ PRISTANKA SUVLASNIKA"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-base-color has-contrast-background-color has-text-color has-background has-link-color wp-elements-7298a8bad91931350ecd113f0a44e6d6\">Eta\u017eiranje bez pristanka suvlasnika<\/h2>\n\n\n\n<p>Eta\u017eiranje, odnosno uspostava vlasni\u0161tva posebnog dijela nekretnine, standardno zahtijeva pisanu suglasnost svih suvlasnika. O <a href=\"https:\/\/marcetic.hr\/index.php\/2025\/02\/28\/postupak-etaziranja\/\" target=\"_blank\" rel=\"noopener\" title=\"postupak eta\u017eiranja\">postupku eta\u017eiranja<\/a> pisali smo u pro\u0161lom \u010dlanku, no ostaje pitanje \u0161to kada potpis suvlasnika izostane?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Uskrata pristanka suvlasnika<\/h2>\n\n\n\n<p>Prema \u010dlanku 73. stavku 2. <a href=\"https:\/\/www.zakon.hr\/z\/241\/Zakon-o-vlasni%C5%A1tvu-i-drugim-stvarnim-pravima\" title=\"\">Zakona o vlasni\u0161tvu i drugim stvarnim pravima<\/a> (ZVDSP), suvlasnik mo\u017ee uskratiti suglasnost za uspostavu eta\u017enog vlasni\u0161tva samo ako bi takva uspostava ograni\u010dila ili isklju\u010dila prava koja mu ve\u0107 pripadaju na temelju njegova prije uspostavljenog vlasni\u0161tva posebnog dijela.<\/p>\n\n\n\n<p>U pro\u0161losti, sudovi su odbijali prijedloge za razvrgnu\u0107e suvlasni\u0161tva uspostavom eta\u017enog vlasni\u0161tva bez suglasnosti svih suvlasnika, \u010desto odre\u0111uju\u0107i civilnu diobu kao alternativu. Me\u0111utim, Vrhovni sud Republike Hrvatske u odluci Rev-1553\/13-2 od 8. sije\u010dnja 2014. zaklju\u010dio je da je sud ovla\u0161ten razvrgnuti suvlasni\u010dku zajednicu uspostavom eta\u017enog vlasni\u0161tva \u010dak i bez suglasnosti svih suvlasnika. Ovo je mogu\u0107e pod uvjetom da uspostava eta\u017enog vlasni\u0161tva ne ograni\u010dava ili isklju\u010duje prava drugih suvlasnika koja im pripadaju na temelju njihovog prije uspostavljenog vlasni\u0161tva posebnog dijela.<\/p>\n\n\n\n<p>Dakle, eta\u017eiranje bez pristanka svih suvlasnika mogu\u0107e je putem sudskog postupka razvrgnu\u0107a suvlasni\u0161tva, pod uvjetom da se time ne naru\u0161avaju prava drugih suvlasnika.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/03\/etaz\u030ciranje-bez-pristanka-suvlasnika-2-1024x768.png\" alt=\"eta\u017eiranje bez pristanka suvlasnika\" class=\"wp-image-2356\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/03\/etaz\u030ciranje-bez-pristanka-suvlasnika-2-1024x768.png 1024w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/03\/etaz\u030ciranje-bez-pristanka-suvlasnika-2-300x225.png 300w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/03\/etaz\u030ciranje-bez-pristanka-suvlasnika-2-768x576.png 768w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/03\/etaz\u030ciranje-bez-pristanka-suvlasnika-2.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Izvanparni\u010dno razvrgnu\u0107e suvlasni\u0161tva<\/h2>\n\n\n\n<p>Kada suvlasnici odbijaju potpisati novi me\u0111uvlasni\u010dki ugovor odnosno protive se uspostavi eta\u017enog vlasni\u0161tva potrebno je pokrenuti izvanparni\u010dni postupak razvrgnu\u0107a suvlasni\u0161tva uspostavom eta\u017enog vlasni\u0161tva.<\/p>\n\n\n\n<p>Postupak je ovla\u0161ten pokrenuti jedan ili vi\u0161e suvlasnika koji imaju odgovaraju\u0107i suvlasni\u010dki dio (primjerice vlasnici eta\u017ee E-3).<\/p>\n\n\n\n<p>Kako u predmetnoj situaciji ne postoji suglasnost svih suvlasnika, sud je kao jednu od pretpostavaka za razvrgnu\u0107e du\u017ean utvrditi je li suvlasni\u010dki dio osobe koja predla\u017ee razvrgnu\u0107e odgovaraju\u0107i u smislu odredaba ZVDSP-a. <\/p>\n\n\n\n<p>Radi se o znanju kojim sud ne raspola\u017ee te je potrebno izvesti dokaz vje\u0161ta\u010denjem. U tom slu\u010daju sud \u0107e \u010desto kao prethodno pitanje rje\u0161avati jesu li suvlasni\u010dki omjeri odgovaraju\u0107i. <\/p>\n\n\n\n<p>Vje\u0161tak \u0107e dati nalaz i mi\u0161ljenje na prethodni elaborat ako on postoji ili \u0107e izraditi novi.  Nakon toga potrebno je elaborat potvrditi kod nadle\u017enog tijela kao i u &#8220;obi\u010dnom&#8221; postupku eta\u017eiranja. <\/p>\n\n\n\n<p>Nakon svega navedenog sud \u0107e raspolagati s dovoljno podataka te biti u mogu\u0107nosti uspostaviti eta\u017eno vlasni\u0161tvo. Sud mo\u017ee uspostaviti eta\u017eno vlasni\u0161tvo \u010dak i u slu\u010daju daljnjeg izostanka suglasnosti jednog ili vi\u0161e suvlasnika.<\/p>\n\n\n\n<p>Zaklju\u010dno, sud mo\u017ee donijeti odluku o razvrgnu\u0107u suvlasni\u010dke zajednice nekretnine i bez suglasnosti jednog ili vi\u0161e suvlasnika ako su za takvo razvrgnu\u0107e ispunjene ostale pretpostavke. ZVDSP propisuje da se vlasni\u0161tvo posebnog dijela mo\u017ee uspostaviti kad postane pravomo\u0107na odluka suda o utvr\u0111ivanju korisnih vrijednosti stana, odnosno druge prostorije, kao i kad nadle\u017eno tijelo na temelju elaborata eta\u017eiranja izra\u0111enog po vje\u0161taku potvrdi da je stan, odnosno druga prostorija samostalna uporabna cjelina te da su izgra\u0111eni u skladu s dozvolom nadle\u017enog tijela. Razvrgnu\u0107e se mo\u017ee provesti ako sud utvrdi da protivljenje suvlasnika razvrgnu\u0107u nema osnovu u zakonu. Svrha sudskog razvrgnu\u0107a suvlasni\u0161tva je omogu\u0107avanje razvrgnu\u0107a kada nema suglasnosti svih suvlasnika pa nema razloga za\u0161to se razvrgnu\u0107e u tom slu\u010daju ne bi moglo provesti uspostavom eta\u017enog vlasni\u0161tva.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Parni\u010dno razvrgnu\u0107e suvlasni\u0161tva<\/h2>\n\n\n\n<p>Ipak, u slu\u010daju da neki od suvlasnika ima opravdani prigovor na uspostavu eta\u017enog vlasni\u0161tva u smislu \u010dl. 73. st. 2. ZVDSP-a sud \u0107e stranke morati uputiti u parni\u010dni postupak.<br><br>\u010cl. 73. st. 2. navodi sljede\u0107e:<br>Niti jedan suvlasnik nekretnine ne mo\u017ee uskratiti svoj pristanak na uspostavu vlasni\u0161tva posebnoga dijela drugom suvlasniku koji ima odgovaraju\u0107i suvlasni\u010dki dio, <strong><span style=\"text-decoration: underline;\">osim ako bi se uspostavom novoga vlasni\u0161tva posebnoga dijela u korist toga suvlasnika ukinula ili ograni\u010dila prava koja njemu ve\u0107 pripadaju na temelju njegova prije uspostavljenoga vlasni\u0161tva posebnoga dijela<\/span><\/strong>.<\/p>\n\n\n\n<p>Primjerice, kada bi se neki od suvlasnika usprotivio da neka prostorija iz elaborata pripada njemu ili svim stanarima, a ne osobi koja ju poku\u0161ava prisvojiti, sud bi ukoliko postoje dovoljno opravdani razlozi morao stranke uputiti u parni\u010dni postupak. <\/p>\n\n\n\n<p>Dakle, ako ne postoje prigovori suvlasnika ili oni nisu opravdani, sud nema nikakve prepreke da o postupku odlu\u010di izvanparni\u010dnim putem. <br>S druge strane, ako netko od suvlasnika po ocjeni suda ipak ima opravdani razlog za prigovor, sud \u0107e stranke morati
