{"id":2308,"date":"2025-02-28T13:16:26","date_gmt":"2025-02-28T12:16:26","guid":{"rendered":"https:\/\/marcetic.hr\/?p=2308"},"modified":"2025-12-30T18:07:40","modified_gmt":"2025-12-30T17:07:40","slug":"postupak-etaziranja","status":"publish","type":"post","link":"https:\/\/marcetic.hr\/index.php\/2025\/02\/28\/postupak-etaziranja\/","title":{"rendered":"postupak eta\u017eiranja"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-base-3-color has-contrast-background-color has-text-color has-background has-link-color wp-elements-44b1fac253f39e759ffc1aa384441eca\"><strong>Postupak eta\u017eiranja <\/strong><\/h2>\n\n\n\n<p>U <a href=\"https:\/\/marcetic.hr\/index.php\/2025\/02\/12\/etaziranje-nekretnine\/\" target=\"_blank\" rel=\"noopener\" title=\"eta\u017eiranje nekretnine\">prethodnom \u010dlanku<\/a> mogli ste nau\u010diti \u0161to je to eta\u017eiranje i za\u0161to je va\u017eno, no u ovom \u010dlanku bavit \u0107emo se prakti\u010dnim koracima kako i na koji na\u010din zapo\u010deti postupak eta\u017eiranja.<br>Eta\u017eiranje je administrativni i pravni postupak koji se provodi u nekoliko faza.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Priprema dokumentacije<\/strong> <strong>za eta\u017eiranje<\/strong><\/h3>\n\n\n\n<p>Prvi korak u postupku eta\u017eiranja je prikupljanje svih potrebnih dokumenata o nekretnini, ve\u0107inu dokumenata mo\u017eete prikupiti sami ili putem odvjetnika.<br><strong>Potrebni dokumenti:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Izvadak iz zemlji\u0161ne knjige &#8211; vlasni\u010dki list (dokaz vlasni\u0161tva nad nekretninom)<\/li>\n\n\n\n<li>Posjedovni list iz katastra<\/li>\n\n\n\n<li>Gra\u0111evinska i uporabna dozvola (ako postoji)<\/li>\n\n\n\n<li>Tlocrt zgrade ili ku\u0107e<\/li>\n\n\n\n<li>Eventualni ugovori o suvlasni\u0161tvu<\/li>\n<\/ul>\n\n\n\n<p>Prije svega, najva\u017eniji dokumenti su izvadak iz zemlji\u0161ne knjige i posjedovni list iz katastra. Njih obavezno morate imate kako bi dokazali vlasni\u0161tvo i znali o kojoj se to\u010dno nekretnini radi. <br>Ostali dokumenti kao \u0161to su tlocrti zgrade ili ku\u0107e mogu Vam pomo\u0107i utoliko \u0161to \u0107ete osobi koja izra\u0111uje elaborat eta\u017eiranja skratiti vrijeme izrade, a mo\u017eda i cijenu. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Izrada elaborata eta\u017eiranja<\/strong><\/h3>\n\n\n\n<p>Elaborat eta\u017eiranja izra\u0111uje <strong>ovla\u0161teni stru\u010dnjak<\/strong> \u2013 naj\u010de\u0161\u0107e<strong> <\/strong>\u0107e to biti upravo<strong> geodet<\/strong>. <br>Pogledajmo \u0161to to\u010dno eta\u017eni elaborat mora sadr\u017eavati..<\/p>\n\n\n\n<p><strong>Klju\u010dni dijelovi elaborata:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To\u010dan opis svake samostalne jedinice (stan, poslovni prostor, gara\u017ea)<\/li>\n\n\n\n<li>Prora\u010dun suvlasni\u010dkih udjela<\/li>\n\n\n\n<li>Skice i nacrti svih eta\u017enih jedinica<\/li>\n\n\n\n<li>Podaci o zajedni\u010dkim dijelovima nekretnine (stubi\u0161tima, hodnicima, dvori\u0161tu)<\/li>\n<\/ul>\n\n\n\n<p>Elaborat mora biti precizan jer na temelju njega sud donosi rje\u0161enje o eta\u017eiranju. U elaboratu \u0107ete mo\u0107i jasno vidjeti nacrte svake eta\u017ee, raspored prostorija i kvadraturu ali i tekstualni dio u kojem \u0107e Va\u0161a nekretnina biti opisana. Potvrda da su posebni dijelovi nekretnine samostalne uporabne cjeline<\/strong><\/h3>\n\n\n\n<p>Nakon \u0161to obavite eta\u017eiranje potrebno je od nadle\u017enog upravnog tijela pribaviti Potvrdu da su posebni dijelovi nekretnine samostalne uporabne cjeline. <br>Uz zahtjev se prila\u017ee novi eta\u017eni elaborat i preslika gra\u0111evinske dozvole, rje\u0161enje o izvedenom stanju ili drugi odgovaraju\u0107i akt (naj\u010de\u0161\u0107e uvjerenje o vremenu gra\u0111enja gra\u0111evine do 15. velja\u010de 1968.).<br>U Gradu Zagrebu Potvrdu izdaje <a href=\"https:\/\/zagreb.hr\/etaziranje-potvrda-da-su-posebni-dijelovi-nekretni\/145890\" target=\"_blank\" rel=\"noopener\" title=\"\">Gradski ured za obnovu, izgradnju, prostorno ure\u0111enje, graditeljstvo i komunalne poslove<\/a><br>Sektor za prostorno ure\u0111enje i graditeljstvo.<br>Potvrdom nadle\u017eno tijelo zapravo potvr\u0111uje da su zgrada, odnosno njezini dijelovi izgra\u0111eni u skladu s izvr\u0161nom odnosno pravomo\u0107nom dozvolom nadle\u017enog tijela za gradnju, te da predstavljaju samostalnu uporabnu cjelinu.<\/p>\n\n\n\n<p>Lai\u010dki re\u010deno, nadle\u017eno tijelo jam\u010di da je sve do sada izgra\u0111eno po zakonu te da je zgrada legalizirana.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/potvrda-samostalne-uporabne-cjeline-postupak-etaziranja-1024x768.png\" alt=\"da su posebni dijelovi nekretnine samostalne uporabne cjeline - postupak eta\u017eiranja\" class=\"wp-image-2327\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/potvrda-samostalne-uporabne-cjeline-postupak-etaziranja-1024x768.png 1024w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/potvrda-samostalne-uporabne-cjeline-postupak-etaziranja-300x225.png 300w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/potvrda-samostalne-uporabne-cjeline-postupak-etaziranja-768x576.png 768w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/potvrda-samostalne-uporabne-cjeline-postupak-etaziranja.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. Potpisivanje me\u0111uvlasni\u010dkog ugovora<\/strong><\/h3>\n\n\n\n<p>Nakon \u0161to ste obavili sve prethodne korake ako nekretnina ima vi\u0161e suvlasnika, <strong>potrebna je njihova suglasnost<\/strong> za eta\u017eiranje. <\/p>\n\n\n\n<p>U me\u0111uvlasni\u010dkom ugovoru navedeni su podaci iz novog elaborata te svaki od suvlasnika potpisuje da je suglasan s podacima koji se nalaze u elaboratu odnosno raspodjelom eta\u017enih jedinica (kvadraturom, opisom idealnih dijelova, osobnim podacima&#8230;) <\/p>\n\n\n\n<p>Bitno je za napomenuti da se potpis ove vrste ugovora uvijek obavlja pred javnim bilje\u017enikom koji potvr\u0111uje identitet potpisnika.<\/p>\n\n\n\n<p> <strong>\u0160to ako neki suvlasnici ne pristanu?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ako postoji <strong>ve\u0107ina<\/strong> suvlasnika koji se sla\u017eu (vi\u0161e od 50%), postupak se mo\u017ee pokrenuti sudskim putem.<\/li>\n\n\n\n<li>Ako nema suglasnosti, potrebno je pokrenuti <strong>parni\u010dni postupak<\/strong> pred sudom.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. Prijedlog za uknji\u017ebu elaborata eta\u017eiranja<\/strong><\/h3>\n\n\n\n<p>Nakon \u0161to ste pribavili elaborat, Potvrdu nadle\u017enog tijela i potpisali me\u0111uvlasni\u010dki ugovor vrijeme je za zadnji korak u postupku eta\u017eiranja &#8211; upis promjene u zemlji\u0161ne knjige <\/p>\n\n\n\n<p>Prijedlog se podnosi putem suda te je za taj dio procesa uvijek potrebno opunomo\u0107iti odvjetnika.
