{"id":2304,"date":"2025-02-12T21:31:57","date_gmt":"2025-02-12T20:31:57","guid":{"rendered":"https:\/\/marcetic.hr\/?p=2304"},"modified":"2025-12-30T18:08:04","modified_gmt":"2025-12-30T17:08:04","slug":"etaziranje-nekretnine","status":"publish","type":"post","link":"https:\/\/marcetic.hr\/index.php\/2025\/02\/12\/etaziranje-nekretnine\/","title":{"rendered":"eta\u017eiranje nekretnine"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-base-color has-contrast-background-color has-text-color has-background has-link-color wp-elements-902c281b9f72f7e4113a76593a404e42\"><strong>Eta\u017eiranje nekretnine<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\">\u0160to je eta\u017eiranje?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Eta\u017eiranje je pravni i tehni\u010dki postupak kojim se jedna nekretnina dijeli na vi\u0161e samostalnih uporabnih\/eta\u017enih cjelina. Eta\u017eno vlasni\u0161tvo bitno je ne mije\u0161ati s eta\u017eama ku\u0107e ili stana. Tako na jednome katu stambene zgrade mo\u017eemo imati nekoliko eta\u017enih cjelina. <br>Primjerice tre\u0107i kat neke zgrade \u010dine stanovi E-10 do E-15.<br>Eta\u017eiranje omogu\u0107uje da svaki stan, poslovni prostor, gara\u017ea ili drugi dio zgrade postane zasebna jedinica s jasno definiranim vlasni\u0161tvom.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kako se eta\u017eiranje odvija u praksi?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Zamislimo da u jednoj zgradi postoji deset stanova i tri poslovna prostora. Ako zgrada nije eta\u017eirana, cijela nekretnina se u zemlji\u0161nim knjigama vodi kao jedna cjelina, a svi vlasnici su upisani kao suvlasnici bez preciznog odre\u0111ivanja tko je vlasnik kojeg dijela. Iako oni naravno tvrde da znaju to\u010dno kojeg dijelu su vlasnici, to zapravo nije tako.<br>To mo\u017ee uzrokovati brojne probleme prilikom prodaje, naslje\u0111ivanja, podizanja kredita ili samog raspolaganja nekretninom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prilikom eta\u017eiranja, vlasnici dobivaju poseban vlasni\u010dki list u zemlji\u0161nim knjigama. <br>Tako \u0107e sada vlasni\u010dki list, osim \u0161to \u0107e uklju\u010divati opis nekretnine, sadr\u017eavati i oznaku eta\u017enog vlasni\u0161tva svakog od suvlasnika (npr. E-13), ali i suvlasni\u010dki udio koji oni imaju u odnosu na cijelu zgradu.<br>Suvlasni\u010dki udjeli bit \u0107e u omjeru prema broju djeljivim s 10 (100,1000 ili 10000). <br>Na taj na\u010din vlasnik svake samostalne cjeline znat \u0107e to\u010dno u kojem je omjeru vlasnik u odnosu na cijelu nekretninu ali i ostale suvlasnike.<br><br>Tako \u0107emo na vlasni\u010dkom listu (ZK ulo\u0161ku) ispod teksta primijetiti da je stan upisan pod eta\u017eom E-8, te da je njegov suvlasni\u010dki omjer u odnosu na cijelu nekretninu 580\/10000. Stan je i dalje ozna\u010den kao S3, neto povr\u0161ine 54,68 \u010dm, ali to ne utje\u010de na broj eta\u017ee niti suvlasni\u010dki udio u cijeloj nekretnini. <br>U ovom slu\u010daju, eta\u017ea E-8 \u010dini 5.8% udjela u cijeloj zgradi. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"1024\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/etaz\u030ciranje-vlasnic\u030cki-list-768x1024.png\" alt=\"eta\u017eiranje - vlasni\u010dki list\" class=\"wp-image-2314\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/etaz\u030ciranje-vlasnic\u030cki-list-768x1024.png 768w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/etaz\u030ciranje-vlasnic\u030cki-list-225x300.png 225w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/02\/etaz\u030ciranje-vlasnic\u030cki-list.png 900w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Za\u0161to je eta\u017eiranje va\u017eno? <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Eta\u017eiranje je va\u017eno prvenstvo kako bi svaki od suvlasnika nekretnine znao to\u010dno \u0161to je njegovo vlasni\u0161tvo, te u kojem je ono omjeru prema cijeloj nekretnini.<br>Poku\u0161at \u0107emo na nekoliko naj\u010de\u0161\u0107ih primjera objasniti za\u0161to je eta\u017eiranje iznimno va\u017eno.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Mogu\u0107nost podizanja kredita i stavljanja hipoteke<\/strong> <\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bez eta\u017eiranja:<\/strong> Ako stan nije eta\u017eiran, on nije pravno odvojena jedinica u zemlji\u0161nim knjigama. To zna\u010di da banka ne mo\u017ee prihvatiti stan kao sredstvo osiguranja za hipotekarni kredit, jer on pravno ne postoji kao zasebna jedinica. Banke \u0107e odbiti dati kredit na takvu nekretninu ili \u0107e tra\u017eiti dodatna sredstva osiguranja.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>S eta\u017eiranjem:<\/strong> Kada je stan eta\u017eiran, banka ga mo\u017ee prihvatiti kao osiguranje za hipoteku jer postoji jasno definiran vlasni\u010dki list u zemlji\u0161nim knjigama. Vlasnik mo\u017ee podi\u0107i kredit i koristiti stan kao jamstvo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U ovom slu\u010daju vidimo da ne samo da je eta\u017eiranje iznimno va\u017eno za kupca nekretnine ve\u0107 i za prodavatelja. Ukoliko va\u0161a nekretnina nije eta\u017eirana, uvelike si smanjujete mogu\u0107nost prodaje, obzirom da ve\u0107ina kupaca nekretnine kupuje upravo putem bankarskog kredita.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To se tako\u0111er odnosi na slu\u010daj kada svoju postoje\u0107u nekretninu koja nije eta\u017eirana \u017eelite koristiti kao zalog pri podizanju novog kredita. Banka Vam jednostavno ne\u0107e odobriti kredit odnosno uzeti Va\u0161u nekretninu kao zalog za novi kredit.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Olak\u0161ana kupoprodaja nekretnine<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bez eta\u017eiranja:<\/strong> Ako zgrada nije eta\u017eirana, kupoprodaja stana mo\u017ee biti komplicirana jer kupac zapravo kupuje suvlasni\u010dki udio u cijeloj nekretnini, umjesto konkretne stambene jedinice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>S eta\u017eiranjem:<\/strong> Kupoprodaja postaje jednostavna jer kupac kupuje konkretan stan koji je pravno definiran i upisan u zemlji\u0161ne knjige.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ne samo da kupac ne\u0107e mo\u0107i ishoditi kredit kod banke, ve\u0107 za nekretninu koja nije eta\u017eirana on nikada nije siguran koji je to\u010dno dio nekretnine kupio. Ovdje do problema u praksi dolazi naj\u010de\u0161\u0107e kada vi\u0161e suvlasnika smatra da pola\u017ee pravo na neke zajedni\u010dke prostorije kao \u0161to su tavan ili podrum, ostave, \u0161upe, dijelovi hodnika, balkoni i sli\u010dno.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. Jasno definirani tro\u0161kovi odr\u017eavanja i re\u017eija<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bez eta\u017eiranja:<\/strong> Vlasnici stanova u neeta\u017eiranoj zgradi \u010desto imaju problema s podjelom tro\u0161kova re\u017eija i odr\u017eavanja. Mo\u017ee do\u0107i do nesuglasica jer nije jasno definirano koliko tko treba pla\u0107ati.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>S eta\u017eiranjem:<\/strong> Svaka jedinica ima vlastite tro\u0161kove re\u017eija, koji se obra\u010dunavaju prema stvarnoj potro\u0161nji ili idealnim suvlasni\u010dkim dijelovima.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U neeta\u017eiranoj zgradi tro\u0161kovi vode i struje \u010desto se dijele prema dogovoru me\u0111u stanarima, \u0161to naravno mo\u017ee izazvati nesuglasice. Nakon eta\u017eiranja, svaki stan ima svoje brojilo i tro\u0161kovi se pla\u0107aju prema stvarnoj potro\u0161nji.
