{"id":2260,"date":"2025-01-19T21:35:23","date_gmt":"2025-01-19T20:35:23","guid":{"rendered":"https:\/\/marcetic.hr\/?p=2260"},"modified":"2025-12-30T18:08:47","modified_gmt":"2025-12-30T17:08:47","slug":"ovrha-na-placi-radnika-agencije-za-potrazivanje","status":"publish","type":"post","link":"https:\/\/marcetic.hr\/index.php\/2025\/01\/19\/ovrha-na-placi-radnika-agencije-za-potrazivanje\/","title":{"rendered":"Ovrha na pla\u0107i radnika &#8211; agencije za potra\u017eivanje"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-base-color has-contrast-background-color has-text-color has-background has-link-color wp-elements-8ccebdeff109a116b09403d46f98f2f9\">Ovrha na pla\u0107i radnika &#8211; agencije za potra\u017eivanje<\/h2>\n\n\n\n<p>\u010cest je slu\u010daj gdje poslodavac od dru\u0161tva za naplatu potra\u017eivanja &#8211; ovrhovoditelja, dobije pisanu opomenu da je obvezan isplatiti odre\u0111eni dio pla\u0107e radnika na ra\u010dun dru\u0161tva koje je izdalo opomenu.<\/p>\n\n\n\n<p>Na taj na\u010din ovrhovoditelji (naj\u010de\u0161\u0107e dru\u0161tva za naplatu potra\u017eivanja) poku\u0161avaju presko\u010diti redoslijed naplate koji je uspostavljen kod FINA-e te svoju tra\u017ebinu eventualno naplatiti prije drugih vjerovnika.<\/p>\n\n\n\n<p>Pri tome, ovrhovoditelji se naj\u010de\u0161\u0107e pozivaju na \u010dl. 284. st. 1. i 2. Ovr\u0161nog zakona i odredbe izvansudske ovrhe. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"901\" height=\"782\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/izvansudska-ovrha-na-placi-radnika.png\" alt=\"Primjer poziva za pla\u0107anje agencije za naplatu potra\u017eivanja.\n\" class=\"wp-image-2266\" style=\"width:1094px;height:auto\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/izvansudska-ovrha-na-placi-radnika.png 901w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/izvansudska-ovrha-na-placi-radnika-300x260.png 300w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/izvansudska-ovrha-na-placi-radnika-768x667.png 768w\" sizes=\"auto, (max-width: 901px) 100vw, 901px\" \/><figcaption class=\"wp-element-caption\">Primjer poziva za pla\u0107anje agencije za naplatu potra\u017eivanja.<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Postoje li slu\u010dajevi kada poslodavac mora postupiti po rje\u0161enju o ovrsi?<\/h2>\n\n\n\n<p>Jedini slu\u010daj kada je poslodavac du\u017ean postupiti po rje\u0161enju je ako <strong><span style=\"text-decoration: underline;\">radniku ne ispla\u0107uje pla\u0107u na ra\u010dun otvoren kod banke<\/span><\/strong>.  <br>Tada ovrhovoditelj mora neophodno dokazati i prilo\u017eiti dokaz da poslodavac doista ne ispla\u0107uje pla\u0107u na ra\u010dun otvoren kod banke, a taj podatak je poslodavac du\u017ean prema \u010dl. 18. st. 1. to\u010d. 6. Ovr\u0161nog zakona dostaviti ovrhovoditelju na njegovo tra\u017eenje.<\/p>\n\n\n\n<p>Ovakvo stajali\u0161te je potvr\u0111eno i sudskom praksom &#8211; odlukama \u017dupanijskog suda u Puli, posl.br: <a href=\"https:\/\/www.iusinfo.hr\/document?sopi=ZSRH2018PuGzOvrB124A2\" target=\"_blank\" rel=\"noopener\" title=\"\">G\u017e Ovr-124\/2018<\/a> od 17. travnja 2018., \u017dupanijskog suda u Zadru, posl.br: <a href=\"https:\/\/www.iusinfo.hr\/document?sopi=ZSRH2019ZdGzOvrB19A2\" target=\"_blank\" rel=\"noopener\" title=\"\">G\u017e- Ovr-19\/2019<\/a> od 16. sije\u010dnja 2019. te \u017dupanijskog suda u Vara\u017edinu, posl.br: <a href=\"https:\/\/www.iusinfo.hr\/document?sopi=ZSRH2019GzOvrB274A2\" target=\"_blank\" rel=\"noopener\" title=\"\">G\u017e-Ovrv-274\/2019<\/a> od 30. srpnja 2020.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Za\u0161to poslodavac ne mora postupiti po zahtjevu ovrhovoditelja?<\/h2>\n\n\n\n<p>Prema sudskoj praksi jedan od glavnih temelja ovog stajali\u0161ta nalazi se u obrazlo\u017eenju Kona\u010dnog prijedloga Zakona o izmjenama i dopunama Ovr\u0161nog zakona. Tako stav zakonodavca jasno glasi: <em>&#8220;Predlo\u017eenom izmjenom odredbe \u010dl. 197 (Ovr\u0161no zakona) ograni\u010dava se odre\u0111ivanje ovrhe na pla\u0107i kod poslodavca s<strong><span style=\"text-decoration: underline;\">amo ako poslodavac ne ispla\u0107uje pla\u0107u na ra\u010dun kod banke<\/span><\/strong>. Na takav na\u010din uklonit \u0107e se problemi uo\u010deni u istovremenoj primjeni odredbi o ovrsi na pla\u0107i i ovrsi na nov\u010danoj tra\u017ebini te \u0107e se <strong><span style=\"text-decoration: underline;\">poslodavci rasteretiti od provedbe ovrhe<\/span><\/strong>&#8220;<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Inzisitiranje ovrhovoditelja na isplati na temelju \u010dl. 201 Ovr\u0161nog zakona<\/h2>\n\n\n\n<p>Neki ovrhovoditelji ni nakon odbijanja poslodavca da postupe po zahtjevu ovrhovoditelja nastavljaju sa svojim zahtjevima te pose\u017eu za pravnim sredstvom iz \u010dl. 201 Ovr\u0161nog zakona &#8211; prema navedenom \u010dlanku, ovrhovoditelj mo\u017ee zatra\u017eiti od suda da nalo\u017ei poslodavcu isplatiti sve obroke \u0161to ih je propustio obustaviti i isplatiti prema rje\u0161enju o ovrsi. <\/p>\n\n\n\n<p>No, ni u ovom slu\u010daju poslodavac nije du\u017ean postupiti po zahtjevu niti \u0107e to u\u010diniti sud. <\/p>\n\n\n\n<p>Da je tome tako ponovno potvr\u0111uje sudska praksa. Tako je \u017dupanijski sud u Bjelovaru, posl.br: <a href=\"https:\/\/www.iusinfo.hr\/document?sopi=ZSRH2019BjGzOvrB57A2\" target=\"_blank\" rel=\"noopener\" title=\"\">G\u017e-Ovr-57\/2019<\/a> u odluci od 15. velja\u010de 2019. u obrazlo\u017eenju iznio sljede\u0107i stav. Iz obrazlo\u017eenja proizlazi da postupak prisilne naplate od ovr\u0161enikovog poslodavca onih iznosa koje je propustio obustaviti od ovr\u0161enikove pla\u0107e pretpostavlja postojanje sudskog ovr\u0161nog postupka protiv ovr\u0161enika, te nepostupanje njegovog poslodavca po rje\u0161enju o ovrsi koje je donio sud, te da stoga nema mjesta pokretanju postupka protiv poslodavca kod izvansudske ovrhe. Ovo stajali\u0161te potvr\u0111eno je i drugim odlukama \u017dupanijskih sudova.<\/p>\n\n\n\n<p>Osim toga, \u017dupanijski suda u Splitu, posl.br: <a href=\"https:\/\/www.iusinfo.hr\/CaseLaws\/Content.aspx?SOPI=ZSRH2020StGzOvrB387A2&amp;Doc=ZUPSUD_HR\" target=\"_blank\" rel=\"noreferrer noopener\">G\u017e Ovr-387\/2020<\/a>&nbsp;u odluci od 27. listopada 2020. potvrdio je takvo stajali\u0161te i sljede\u0107im tuma\u010denjem.<br>U obrazlo\u017eenju odluke, sud isti\u010de kako odredbom \u010dl. 284. st. 2. Ovr\u0161nog zakona na koji se naj\u010de\u0161\u0107e pozivaju ovrhovoditelji (a koja nala\u017ee da ovrhovoditelj isplati iznos kojim bi se namirila tra\u017ebina ovrhovoditelja), nije derogirana odredba \u010dl. 197. st. 1.
