No, idemo pogledati \u0161to propisuje <a href=\"https:\/\/www.zakon.hr\/z\/307\/Zakon-o-radu\" title=\"\">Zakon o radu<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Smanjenje pla\u0107e jednostranom odlukom poslodavca<\/h2>\n\n\n\n<p>Ugovor o radu je dvostranoobvezuju\u0107 te pla\u0107u poslodavac nije u mogu\u0107nosti mijenjati (smanjivati ali niti pove\u0107avati) dono\u0161enjem jednostrane odluke.<br>Za promjenu je potrebna suglasnost obiju strana te \u0107e smanjenje ili pove\u0107anje pla\u0107e uvijek zna\u010diti potpisivanje novog aneksa ugovora o radu. <br>Dakle,<strong> nitko ne mo\u017ee jednostrano izmjenjivati odredbe o pla\u0107i<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Smanjenje pla\u0107e radi pogre\u0161ke na radu<\/h2>\n\n\n\n<p>Poslodavac mo\u017ee uskratiti djelomi\u010dnu isplatu pla\u0107e radniku u slu\u010daju kada prema njemu ima nastalo potra\u017eivanje &#8211; institut kada dvije strane imaju me\u0111usobna potra\u017eivanja naziva se<strong> prijeboj<\/strong>. <br>Prijebojem tra\u017ebine poslodavac mo\u017ee svoju tra\u017ebinu prema radniku &#8220;prebiti&#8221; na na\u010din da mu ne isplati dio ili cijelu pla\u0107u.<br>To je naj\u010de\u0161\u0107e slu\u010daj kada radnik poslodavcu <strong>uzrokuje \u0161tetu te mu je istu du\u017ean i nadoknaditi<\/strong>.<\/p>\n\n\n\n<p>No, stvar nije tako jednostavna. Prije svega, prijeboj pla\u0107e mo\u017ee se izvr\u0161iti <strong>jedino uz pristanak radnika<\/strong>, jednako kao i prethodno spomenuto smanjenje pla\u0107e. <\/p>\n\n\n\n<p>Vrlo je bitno da radnik <strong>nikada ne mo\u017ee unaprijed dati svoju suglasnost<\/strong>. <br>To zna\u010di da radnik i poslodavac ne mogu unaprijed dogovoriti da \u0107e radnik u odre\u0111enim slu\u010dajevima snositi posljedice umanjenjem njegove pla\u0107e. <br>Ovo treba razlikovati od \u010dl. 108 <a href=\"https:\/\/www.zakon.hr\/z\/307\/Zakon-o-radu\" title=\"\">Zakona o radu<\/a> koji propisuje Unaprijed odre\u0111eni iznos naknade \u0161tete. <br><br>Dakle, iako poslodavac pravilnikom o radu mo\u017ee odrediti da \u0107e se primjerice razbijanje \u010da\u0161e od strane radnika tijekom rada u kafi\u0107u &#8220;ka\u017enjavati&#8221; s 2,00 eura, poslodavac ni na koji na\u010din ne mo\u017ee samostalno taj iznos odbijati od pla\u0107e radnika bez njegovog pristanka.<\/p>\n\n\n\n<p>Prijeboj mo\u017ee biti izjavljen usmeno i pismeno, razvila se odre\u0111ena praksa u kojoj poslodavac gotovo uvijek s radnikom potpisuje izjavu o prijeboju tra\u017ebine u kojoj su me\u0111usobno opisane obje tra\u017ebine, osobito ako se radi o tra\u017ebinama koje nisu utvr\u0111ene pravilnikom o radu. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/prijeboj-place-radnika-1-1024x768.png\" alt=\"Smanjenje pla\u0107e radniku.\" class=\"wp-image-2282\" srcset=\"https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/prijeboj-place-radnika-1-1024x768.png 1024w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/prijeboj-place-radnika-1-300x225.png 300w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/prijeboj-place-radnika-1-768x576.png 768w, https:\/\/marcetic.hr\/wp-content\/uploads\/2025\/01\/prijeboj-place-radnika-1.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">\u0160to ako radnik ne pristane na prijeboj ali mu poslodavac i dalje uskrati isplatu &#8211; smanji pla\u0107u?<\/h2>\n\n\n\n<p>\u010clankom 92. st. 6. <a href=\"https:\/\/www.zakon.hr\/z\/307\/Zakon-o-radu\" title=\"\">Zakona o radu<\/a> propisano je da zbog neisplate pla\u0107e radnik mo\u017ee izvanredno otkazati ugovor o radu. U tom slu\u010daju rok od petnaest dana za izvanredni otkaz po\u010dinje te\u0107i nakon proteka zakonskog, odnosno kolektivnim ugovorom ili ugovorenom o radu odre\u0111enog roka za isplatu pla\u0107e. U slu\u010daju nastavne neisplate pla\u0107e, primjerice za sije\u010danj i velja\u010du, rok se tako\u0111er ima smatrati nastavnim, odnosno mo\u017ee se izjaviti u roku od petnaest dana, ra\u010dunaju\u0107i od dospije\u0107a pla\u0107e za velja\u010du.<\/p>\n\n\n\n<p>Odluka radnika o izvanrednom otkazivanju mora biti pisana te mora biti dostavljena poslodavcu.<\/p>\n\n\n\n<p>Tako\u0111er, stranka ugovora o radu koja izvanredno otka\u017ee ugovor o radu, ima pravo od stranke koja je kriva za otkaz tra\u017eiti naknadu \u0161tete zbog neizvr\u0161enja ugovorom o radu preuzetih obveza. <\/p>\n\n\n\n<p><strong>Zavr\u0161no, poslodavac nikada ne mo\u017ee bez suglasnosti radnika smanjivati mu pla\u0107u, \u010dak i ako prema njemu ima
